Appeal lodged as plans to convert garden for Kenilworth dog care business refused

An appeal to try to force through plans for a new dog daycare business in Kenilworth has been dismissed.
Warwick District Council had already refused planning permission for 'Kenilwoof Canine Castle' to use the back garden of a home on Turton Way for the scheme.
Plans would have seen the change of use for the garden as well as a "summerhouse style building" to house the dogs and a secondary gate to make it harder for the pets to escape.
The application said the dogs would only be on site for three-and-a-half hours per day, with the operating times - Monday to Friday between 9am and 4pm - including pick up and drop off for the animals, and the dogs being taken off site for a countryside walk.
But an appeal of the council's decision has now been refused by the planning inspectorate which said the business would negatively impact neighbours.
"Whilst the dogs would spend only a few hours in the dog care area, due to a combination of factors such as small garden, close proximity to neighbouring residential dwellings, and unpredictable nature of dogs, noise is likely to occur, albeit intermittently, which would nonetheless be noticeable and harmful to the living conditions of nearby occupiers," a report said.
"The noise impact would be worse during the warm months when occupiers of neighbouring dwellings are more likely to be using their gardens or have their windows open."
It continued: "The appellant asserts that, as an individual, they could have several dogs.
"Be that as it may, this is not an alternative to the proposal and there is no substantive evidence before me in this regard."
