Environmental Health objects to licence for popular outdoor bar in Kenilworth
Environmental Health has objected to a temporary licence for an outdoor bar in Kenilworth saying it would be a "noise nuisance" for neighbours.
Garden Bar at the Pavilion has applied for a temporary event notice (TEN) for a family event on April 16.
The Pavilion plans to use "local food vans to supply food and an outdoor bar serving alcohol and soft drinks".
But the public body said the Castle Road bar should be forced to close at 9pm so as not to disturb neighbours.
"Environmental Health object on the grounds that there is likely to be noise nuisance to nearby residents from activity on the site and the dispersion of customers late at night leaving the event," it said in a statement to Warwick District Council.
"The potential for nuisance from the activities described in the notice would be greatly reduced if the event were to finish at 9pm."
The objection added: "The notice makes no mention of musical entertainment (possibly because this does not require a licence before 11pm).
"If amplified music or public announcements are intended during the event, then further measures may be necessary to prevent nuisance."
Environmental Health and the police are the only public bodies that can object to a TEN application.
WDC's licensing committee is set to discuss the application tomorrow afternoon (March 22).
Community response
Garden Bar at the Pavilion has already come under fire from Kenilworth Town Council and neighbours for its events.
KTC wrote the district council to ask it to check whether the bar was breaking any planning laws.
Whilst nearby residents have complained about excessive noise.
"The people in Castle Road have been disturbed frequently and into the early hours," said Cllr Michael Coker.
"In this last week in particular it has concerned me that the general theme was that people were not so much angry but actually depressed.
"Depressed as to what they had to look forward to each weekend without anything happening to protect them."
But Gabrielle Parry, who owns the bar, has said it feels like there is a "witch hunt" against her, and that all she wants to do is support local businesses and run community events at the Pavillions.
"Councillors haven't been to see what is happening - they are just going off gossip from the neighbours," she said to Nub News.
"It's really sad because I think you have got to hear both sides.
"It all seems to be one sided and I seem to be excluded."
Adding: "I have had so much positivity from people saying 'you're doing such a great thing for Kenilworth'.
"Then you see what the council has said and it just absolutely brings you down, it is devastating."
