Fresh bid for Kenilworth pub to keep barbecue shed after appeal refused

The saga around a controversial barbecue shed at a Kenilworth pub continues with a fresh application for the structure now submitted.

The Royal Oak has already had an application for the structure - which is already built - refused.

The pub then submitted an appeal which was dismissed by the planning inspectorate.

And now a fresh planning application for the shed has been submitted by Mr & Mrs Warwick ltd.

“It is considered that the proposal will cause minimal harm to the rear garden area,” the fresh application said. 

“Careful consideration of material, size and position have been taken. 

“The ‘shed’ will be set 1.2m away from the neighbouring boundary wall and fixed direct to the already existing concrete slab patio area. 

“There are no neighbouring windows looking directly onto the proposal and due to its minimal height, will not be visible from anywhere other than in the rear garden of the Royal Oak. 

“Design has been carefully considered to use a treated timber ‘shiplap’ design. 

“This minimised impact and creates the feel of a more temporary structure as opposed to solid brickwork.”

A drawing of the structure - dated April 2023 - has been submitted.

The latest proposals do not go into detail on the differences from the previously refused plans.

The application continued: “The proposed area is at present an existing open paved patio area with seating. 

“We propose a small ‘shed’ designed in shiplap treated timber to house our new indoor barbeque pits. 

“These ‘cookers’ are housed internally and require no gas and are economically efficient running off pellets. 

“Once started, the ‘cookers’ slow cook meat products throughout the day ready for the proposed opening hours. 

“They are not left on over night and provide no noise when in use.”

Plans state the BBQ would only be used Friday to Sunday and would close at 10pm each night.

When the previous application was discussed by Warwick District Council, it was judged the plans for the grade II listed pub "would harm living conditions at neighbouring properties", outweighing the economic benefits for the pub. 

The appeal was dismissed due to the possible impact on neighbours.
